California's attorney general said his office sent out subpoenas on Wednesday in a probe into whether Hewlett-Packard Co. used illegal means to investigate 2005 boardroom leaks.

HP said some form of "pretexting" for phone record information had been used in its investigation of leaks in 2005.

Pretexting involves calling a telephone company pretending to be a customer to obtain calling records without that customer's permission.

"There are potentially two penal statutes that have been violated that could result in criminal liability," California Attorney General Bill Lockyer told Reuters in a telephone interview. "They are identity theft and illegally getting information out of a computer system such as AT&T phone records."
